There might be reasons why an applicant is unable to provide a valid passport when applying to the Home Office to extend their visa or leave to remain in the UK. For instance, an individual may never possessed a passport for a number of reasons, including reasons outside of the applicant’s control. In such circumstances, a person may be unable to get a national passport from their country’s authorities.

Commonly, a passport may also have been lost or expired. In some cases, the supporting documentation required to obtain a new passport is simply unavailable.

If you do not hold a valid passport, it does not necessarily mean that your visa application won’t be accepted, however you need to demonstrate there is a reason beyond your control why you could not provide it.

The Home Office may normally exercise a discretion if a good reason can be provided and evidenced, including but not limited to the situations where:

1.      The applicant’s passport is held by the Home Office;

2.      The applicant’s passport has been lost or stolen and no replacement can be issued;

3.      The applicant holds a refugee leave to remain or a status of Humanitarian protection;

4.      The applicant is applying for leave as a stateless person

5.      A good reason beyond applicant’s control has been provided, why a proof of identity can’t be demonstrated.

In most cases, the absence of a valid passport does not automatically result in the refusal of an application. Instead, the Home Office may exercise discretion and consider the application where credible reasons are provided for the lack of a passport.

Additionally, the applicant must demonstrate that they have made genuine efforts to supply alternative evidence of identity and that the circumstances preventing them from providing a passport were beyond their control.
