Are you eligible for an automatic grant of Settled status?

The Home Office will automatically upgrade the status from pre-settled to settled, without requiring a formal application. However, this will not apply to everyone.
To determine eligibility, the Home Office is reviewing UK tax and benefits records to check whether individuals meet the residence requirements.
At present, you can expect to be granted settled status automatically if:
-You are a citizen of an EEA country or Switzerland;
-You were living in the UK by 11pm on 31 December 2020; and your tax and benefit records show you have lived in the UK for five years, with no more than six months’ absence in any 12-month period.
However, not everyone will qualify for automatic conversion. You will still need to apply if you:
-Have not paid UK tax or received benefits for at least 30 months in the past five years;
-Are a non-EEA or non-Swiss family member;
-Are a joining family member who moved to the UK after 31 December 2020; are under 18; or rely on more complex eligibility criteria, such as derivative rights.
-A family member of a naturalized British Citizen (i.e. Surinder Singh route)
If you fall into one of these categories above, it is advisable to apply for settled status to secure your permanent right to live in the UK.
